Guest means any person making a booking or staying at a property managed by Whitsunday74 Pty Ltd.

Property means the holiday accommodation booked through Whitsunday74 Pty Ltd.

Booking means any reservation confirmed through our website, booking systems, or direct communication.

These Terms and Conditions govern the use of our website, booking platform, holiday accommodation services, and all related interactions with Whitsunday74 Pty Ltd (“Whitsunday74”, “we”, “our”, or “us”).

By accessing our website or making a reservation with Whitsunday74 Pty Ltd, you agree to comply with and be bound by these Terms and Conditions.

If you do not agree with any part of these Terms, you must not use our website or booking services.

Minimum Age

The person making the booking must be at least 21 years of age unless otherwise approved in writing by Whitsunday74 Pty Ltd.

Valid Identification

We reserve the right to request government-issued photo identification before confirming or during any booking.

Payment Terms

For direct bookings made through whitsunday74.com.au and Stayz/VRBO a 20% deposit is payable at the time of booking, with the remaining balance due 30 days prior to arrival. Bookings made within 30 days of arrival require full payment at the time of booking.

For bookings made through third-party platforms (Airbnb, Marriott, Booking.com and others), payment is collected by the platform in accordance with its own payment schedule and terms.

Failure to pay the balance by the due date may result in cancellation of the booking in accordance with our cancellation policy.

A valid credit card in the lead guest’s name is required for all bookings, regardless of the platform used, and must be provided before arrival. This card may be used to hold a security bond or pre-authorisation and to recover any amounts owing under these terms.

Security Bond

A security bond or pre-authorisation is required before check-in.

Whitsunday74 Pty Ltd reserves the right to deduct reasonable costs for:

•    property damage,

•    excess cleaning,

•    missing items,

•    smoking violations,

•    unauthorised guests,

•    breaches of house rules,

•    buggy damage,

•    or other losses caused during the stay.

Guest Cancellations

Cancellation terms may vary depending on the property and booking platform used. Unless otherwise specified:

•    Cancellations made more than 30 days before arrival may receive a partial or full refund less administration fees.

•    Cancellations made within 30 days of arrival may result in forfeiture of monies paid.

•    No-shows and early departures are non-refundable.

Force Majeure

Whitsunday74 Pty Ltd shall not be liable for cancellations, interruptions, or changes caused by events outside our reasonable control, including but not limited to:

•    extreme weather,

•    cyclones,

•    natural disasters,

•    government restrictions,

•    pandemics,

•    utility outages,

•    transportation disruptions.

Where possible, reasonable alternatives or credits may be offered at our discretion.

Unless otherwise stated:

• Check-in: from 2:00 PM
• Check-out: by 10:00 AM
• 

Late check-out or early check-in requests are subject to availability and may incur additional charges.

Guests agree to:

•    keep the property clean and secure,

•    comply with all house rules,

•    behave respectfully toward neighbours and local residents,

•    comply with all local laws and body corporate regulations,

•    avoid excessive noise or disturbances.

Guests must not:

•    hold parties or events without written approval,

•    exceed maximum occupancy limits,

•    smoke inside the property,

•    engage in illegal activity,

•    bring pets unless approved in writing.



Any breach may result in immediate termination of the booking without refund.

Where a buggy/golf buggy is provided with the property, its use is entirely at the Guest’s own risk. By using the buggy, the Guest acknowledges and agrees that:

•    Whitsunday74 Pty Ltd accepts no liability for any injury, death, accident, loss, or damage suffered by any person arising from the use or operation of the buggy.

•    Guests use the buggy entirely at their own risk and assume full responsibility for all persons using or travelling in the buggy during the booking period.

•    The buggy must only be operated by licensed drivers who are legally permitted to drive in Queensland, Australia.

•    All buggy drivers must be a minimum of 21 years of age unless otherwise approved in writing by Whitsunday74 Pty Ltd.

•    Guests may be required to provide a valid driver licence prior to check-in or during their stay.

•    Guests must comply with all applicable laws, resort regulations, body corporate rules, and local traffic requirements relating to buggy operation.

•    The buggy must not be operated while under the influence of alcohol, drugs, or any substance that may impair driving ability.

•    The buggy must not be used recklessly, off designated roads or paths, overloaded beyond manufacturer recommendations, or used for commercial purposes.

•    Guests are fully responsible for securing the buggy and keys at all times during their stay.

The Guest accepts full financial responsibility for:

•    any damage to the buggy, accidental, negligent, malicious, theft, vandalism, or misuse,

•    loss of keys,

•    flat batteries caused by guest negligence,

•    towing and recovery costs,

•    insurance excess charges,

•    cleaning costs,

•    loss of use,

•    administrative costs,

•    and all repair or replacement costs incurred during or arising from the booking period.

Whitsunday74 Pty Ltd reserves the right to charge the Guest’s nominated payment method, security bond, or credit card for all reasonable costs associated with buggy damage, repairs, recovery, replacement, insurance excesses, or breaches of these Terms and Conditions. Where insurance applies, the Guest remains liable for any applicable insurance excess and any costs not covered by insurance.

• Whitsunday74 Pty Ltd makes no warranty regarding the suitability, condition, reliability, or fitness of the buggy for any particular purpose and shall not be liable for any interruption, breakdown, mechanical failure, or inability to use the buggy during the stay. Any breach of this section may result in immediate termination of the Guest’s right to use the buggy without refund or compensation.

Complimentary Buggy Disclaimer

The golf buggy provided at the property is a complimentary amenity and is not included as part of the rental accommodation. While every effort is made to ensure the buggy is available for guest use, availability cannot be guaranteed.

In the event that the buggy is unavailable, inoperable, undergoing maintenance, or otherwise unable to be provided for any reason, this shall not constitute a breach of the booking agreement and will not entitle the guest to a refund, discount, compensation, cancellation, or any other claim against the Owner or Property Manager.

To the maximum extent permitted by law:

•    Whitsunday74 Pty Ltd shall not be liable for loss, theft, injury, accident, delay, or damage suffered by guests during their stay.

•    Guests use the property and all facilities entirely at their own risk.

•    We are not responsible for personal belongings left at properties.



Nothing in these Terms excludes rights available under the Australian Consumer Law
